The placing of an order includes the acceptance of our terms of delivery and payment. Statements on our part regarding delivery time are only approximate and non-binding. Claims for damages due to delayed delivery are excluded against us, unless they are based on intent or gross negligence.
JenCam GmbH reserves the unrestricted property and copyright exploitation rights to cost estimates, drawings and other documents; they may only be made accessible to third parties after prior written release by JenCam GmbH. Drawings and other documents belonging to offers shall be returned immediately upon request if the order is not placed with JenCam GmbH. This shall also apply in the reverse case to the documents of the orderer. However, these may be made accessible to such third parties to whom JenCam GmbH has permissibly assigned deliveries and services.

Delivery shall be made in the order in which the order is received and within the scope of the orderer's respective credit limit. No liability is assumed for delays due to force majeure, operational or transport delays, etc. If technical improvements are introduced after acceptance of orders, JenCam GmbH reserves the right to deliver the improved products.
Additional agreements are only valid if they are confirmed in writing. Delivery of the ordered goods will only be made against invoice. Goods returns for credit are not permissible.

The customer acknowledges that software is complex and not completely error-free. We do not guarantee that software is error-free. The customer is entitled to use the software in the purchased number of permissions.

Our prices are in Euro ex Jena. All orders will be invoiced at the prices and conditions valid on the day of delivery. In the event of price increases between the placing of the order and delivery, the customer has the right to withdraw from the contract, provided that he declares his withdrawal immediately after becoming aware of the new prices.

For orders up to a net goods value of € 75, we charge a surcharge of € 25 net.

The shipment of the goods is at the expense and risk of the buyer. No liability for damage or loss during transport is assumed by us. Upon request and at the expense of the customer, we take out transport insurance.

Invoices of JenCam GmbH are payable with 2% discount within 10 days and net within 30 days after delivery and invoicing. For the timeliness of payments it is decisive that JenCam GmbH can dispose of the credit note without reservation. JenCam GmbH is entitled to claim interest on arrears from the due date without proof in the amount of 3 % above the respective discount rate, without prejudice to the possibility to claim a higher actual damage.

All goods delivered shall remain our property until full payment of all claims against the customer to which we are entitled at the time of delivery of the goods. The buyer may only deliver and sell the goods delivered by us to third parties in the normal course of business before they have been paid for in full. In the event of resale of the delivered goods, the buyer hereby assigns to us his claim arising from the resale of the goods subject to retention of title - we accept this assignment. The conclusion of delivery contracts shall not constitute a claim to the conclusion of further contracts of this kind.

We provide the purchaser with a warranty for the products delivered by us for a period of 12 months, calculated from the date of sale to the end user. The guarantee refers exclusively to the repair of material and manufacturing defects. Further claims for replacement are excluded from the warranty. The warranty promise also expires in the event of third-party intervention as well as damage caused by the use of third-party accessories. The customer must notify us in writing of any obvious defects or the absence of warranted characteristics within 7 days of receipt of the goods. Defects that could not be discovered during the inspection must be reported in writing immediately after discovery, but no later than 12 months after receipt of the goods. We provide warranty for defects of the goods delivered by us for the period of 12 months after receipt of the goods at our discretion, either by repair, new delivery or replacement of the reduced value. If the defect cannot be remedied or if we refuse to remedy the defect, we shall, at the customer's option, either deliver a replacement free of charge, reimburse the reduced value or take back the goods against reimbursement of the purchase price. Further claims for compensation which are not based on intent or gross negligence on our part are excluded.

Repairs must be sent in free of charge. Repairs will only be carried out in our own workshop or in a workshop of our choice. Upon request, we will provide a cost estimate. Cost estimates will be charged with Euro 15,- plus postage, packing and VAT , if the order for repair is not placed. The return shipment will be made in any case by normal parcel post, special shipping methods are at the expense of the client. We provide a warranty of 6 months on the repair carried out.

In accordance with § 33 BDSG, we point out that we store personal data if they are related to the business relationship.

Place of performance for delivery and payment is Jena.

Additional agreements have not been made. Additional agreements besides these general terms and conditions, as well as the agreement of their cancellation or non-applicability, as well as the declaration of conversion, reduction and termination must be made in writing. This also applies to the waiver of the written form requirement.
